Guardianship North Carolina

Guardianship may be in order if your loved one doesn’t have someone appointed to act on their behalf. If your loved one is no longer capable of taking care of themselves, the appointment of a guardian is necessary to manage their care.

Who will make critical health care decisions, including living arrangements? Who will manage financial matters or care for your minor children when you can’t?

Minor Children

If you have minor children, consider who would care for them after your death. This person would be the minor’s guardian. A North Carolina court will ultimately decide who the guardian is, but significant weight is given to the person nominated for this role. 

Aging Parents

If a parent has not planned ahead and drafted directives appointing substitute decision-makers, a court may have to appoint a Guardian for the parent if they have become legally incompetent.  Serving as a Guardian is a significant legal responsibility.
